JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with Supaul P.S. Case No.135 of 2017, disclosing offences under Sections 304B and 34 of IPC.

Petitioner happens to be the husband of the deceased and the case of dowry death.

Submission of the learned counsel for the petitioner is that as a matter of fact, she suffered from Dehydration and she was taken hospital, where she died.

Heard learned A.P.P. and learned counsel appearing on behalf of the informant, has opposed the prayer for bail by stating that there is allegation of administering poison in the mouth of deceased by the petitioner.

Having heard both sides, on perusal of the viscera report, it appears that Aluminum Phosphide was detected in the

Patna High Court CR. MISC. No.13282 of 2019(5) dt.27-06-2019 2/2 contents of plastic jars known as Celphos, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
