JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 04-09-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Raxaul P.S. Case No. 28 of 2015 registered under Sections 304-B read with 34 and 201 of the Indian Penal Code. It is contended that there is no allegation against the petitioner that he ever subjected the victim to cruelty for nonfulfilment of demand of dowry. The specific allegation of colour T.V. is confined against the husband of the deceased, namely, Pramod Ram. So far as the petitioner is concerned, he has been made accused simply because he happens to be elder brother of

Learned counsel for the State after going through the case diary has submitted that there is no allegation of demand of any kind as against the petitioner.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender within a period of four weeks, the petitioner is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Raxaul at Motihari, East Champaran in connection with Raxaul P.S. Case No. 28 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C.
