2. The petitioner, who is in custody since 20.02.2017 has renewed his prayer for bail in connection with Gangabridge P.S. Case No. 18 of 2017 for the offences alleged under Sections 30(a) and 35(a) of the Bihar Prohibition and Excise Act, 2016 having earlier been rejected by this Court by order dated 06.07.2017 in Criminal Miscellaneous No. 20192 of 2017.
3. Learned counsel for the petitioner submits that he has alleged to have accompanied the owner of the liquor namely, Chhotan Rai on a motorcycle for taking away the goods and has remained in custody for seven months. Co-accused Fanfan Singh who is the driver of the pick up van has since been granted bail by
Patna High Court Cr.Misc. No.42606 of 2017 (2) dt.20-09-2017 this Court in Cr. Misc. No. 29317 of 2017. The petitioner claims clean antecedents.
4. Be that as it may, having regard to the entirety of the facts and circumstances of the case as well as the period of custody since 20.02.2017 already suffered, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Gangabridge P.S.
