JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Piprahi P.S. Case No. 100 of 2022 registered for the offences punishable under Sections 323, 324, 341, 342, 379/34 of the Indian Penal Code.
As per the prosecution case, co-accused person including the petitioner assaulted the informant and his son. Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. There is admitted land dispute and Title suit is pending between the parties and both the parties are Pattidars. There is general and omnibus allegation levelled against the petitioner. It is further submitted that petitioner has clean antecedent as stated in para-3

Considering the fact that no specific overt act has been attributed against the petitioner as well as submissions of the parties, let the above named petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate, Sheohar in Piprahi P.S. Case No. 100 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
