The petitioner apprehends his arrest in Jalley P.S. Case No. 189/2015, registered for the offence punishable under Sections 363, 366A, 379 of the Indian Penal Code and under Sections 4, 8, 10 and 12 of POCSO Act.

The informant made allegation that the petitioner kidnapped his minor daughter, but the victim was major, she made her statement under Section 164 Cr.P.C. and disclosed that her age is 19 years and she had love affair with the petitioner and that is why she left her house went along with the petitioner and solemnized marriage. The victim is living in the house of petitioner.

Considering the facts aforesaid, the petitioner, in the

Patna High Court Cr.Misc. No.12257 of 2016 (3) dt.29-06-2016 2/2 event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Session Judge-cum-Special Judge (POCSO Act), Darbhanga in connection with Jalley P.S. Case No. 189/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
