====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Kumar Bimkramdeo Singh, learned counsel assisted by Sri Sada Nand Roy, learned counsel for the petitioner and Sri D.N. Tiwary, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 29.07.2017 in Khagaria P.S. Case No. 455 of 2017 registered for the offence under Section 272, 273/ 34 of the Indian Penal Code 1860 and Section 30(a) of the Bihar Prohibition and Excise Act , 2016 has prayed for grant of bail primarily on the ground that nothing was recovered from conscious possession of the petitioner. He submits that in the present case recovery of huge quantity of Indian make foreign liquor was shown from a graveyard however petitioner has falsely been made accused in

Patna High Court Cr.Misc. No.41444 of 2017(2) dt.15-09-2017 2/2 the present case. Learned counsel for the petitioner has specifically referred to paragraph no. 3 of the petition to show that petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner Sonu Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 3rd, Khagaria / concerned court in connection with Khagaria P.S. Case No. 455 of 2017.
