This application for regular bail arises out of Harnaut (Kalyan Bigha) P.S. Case No. 123 of 2020, disclosing the offence punishable under Section 302 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is in custody since 10.04.2020. His prayer for regular bail was earlier rejected by this Court by an order dated 01.09.2021, passed in Cr. Misc. No. 48345 of 2021. By filing the present application the petitioner has renewed his prayer for bail.
By an order of this Court dated 13.04.2022, a report was called for from the court below as regards present stage of
Patna High Court CR. MISC. No.16419 of 2022(3) dt.11-05-2022 2/2 trial. A report has accordingly been submitted, from which it appears that the prosecution evidence is closed and argument could not be concluded because of several adjournments sought by the defence.
In such view of the matter, I am not inclined to grant the petitioner privilege of regular bail for the present, considering the fact that the conclusion of trial is being delayed because of several adjournments sought on behalf of the defence.
This application is accordingly rejected.
