The petitioner apprehends his arrest in a case registered for the offence under Section 406 of the Indian Penal Code.

As per the prosecution case, this petitioner took a loan of Rs. 7 lacs from the informant and later on, he gave a cheque of Rs. 7 lacs to the informant and when informant deposited the same, it got bounced.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. No such occurrence, as alleged in the F.I.R., has ever taken place. In fact, the petitioner had taken a loan of Rs. 50,000/- from the informant and given a signed blank cheque to the informant in security and later on, the petitioner returned the aforesaid amount to informant and requested him to return the said blank cheque, but the informant told him that the cheque in question has been misplaced and

Patna High Court CR. MISC. No.21825 of 2023(2) dt.06-07-2023 2/2 intentionally filled the huge amount of Rs. 7 lacs in the said cheque, which got dishonoured and lodged this false case. However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioner is author of the said cheque, which got dishonoured due to insufficient fund.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
