====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-04-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Section 414 of the Indian Penal Code and Section 30(a) (d) of the Bihar Excise Amendment Act, 2016.

It is contended that, as per allegation, 4.50 quintals of Jawa Mahua was recovered from the possession of the petitioner. The petitioner claims that she was standing on the road to catch the auto rickshaw but she has been apprehended. It is urged that the petitioner, who is a lady, is in custody since 12.11.2017. It is claimed that her antecedent is clean. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court Cr.Misc. No.19746 of 2018(2) dt.19-04-2018 2/2 with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 7959 of 2017 arising out of Kotwali P.S. Case No. 613 of 2017 with a condition that if the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
