The petitioner is languishing in custody since 18.09.2018 in a case registered for the offences punishable under Sections 25(1-B)a and 26 of the Arms Act. The prosecution case is that from the possession of the petitioner, one loaded country made pistol and four live cartridges were recovered.
It is submitted by learned counsel for the petitioner that nothing has been recovered from the conscious physical possession of the petitioner. It is further submitted that the
Patna High Court CR. MISC. No.14641 of 2019(2) dt.11-03-2019 2/2 investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP for the State submits that the recovery has been made from the possession of the petitioner. Considering the fact that the investigation has already been concluded, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Bihar Sharif in connection with Manpur P.S.
