2. The petitioners seek bail in connection with Pasraha P.S. Case No. 194 of 2024 registered for the offence under Sections 103(1), 115(2), 126(2), 329(3), 352, 3(5) of the BNS.

3. As per the prosecution case, altogether seven persons are said to have assaulted the deceased with bricks etc. and the petitioners are also said to have participated in the killing.

4. The petitioners are in custody since 27.09.2024.

5. Learned counsel for the petitioners submits that the petitioners are the husband and wife and there are general and omnibus allegation against the petitioners.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria/concerned Court below in connection with Pasraha P.S. Case No. 194 of 2024.

8. As a condition of this order, the petitioners, after being released on bail are directed to co-operate in the trial personally till the framing of the charge and thereafter they will appear personally or through their lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
