After having gone through the written report, this Court could not, at least, comprehend as to what was the amounts defalcated by the petitioner. Put in one line, the allegation is that no report was made by the Headmaster, i.e., the present petitioner as to what was the amount left in the account of the school out of Rs.20,57,700/- which was advanced for construction of the school building. Over Rs.10,12,000/- has been spent, admittedly, on the construction. Not submitting a statement as to what was the balance left in the account. In the opinion of the Court could not be creating an offence especially an offence of criminal breach of trust or embezzlement of public money.

Regard being had to the above facts, let the above named petitioner be directed to be released on bail either in the

Patna High Court Cr.Misc. No.17125 of 2015 (2) dt.23-07-2015 event of her arrest by the police or surrender in the court below on furnishing a bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of ACJM, Khagaria in connection with Alauli P.S. Case No. 306 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dharnidhar Jha, J) B.Kr./- U T
