2. The petitioner seeks bail in connection with Laheriasarai P.S. Case No. 487/2023 registered for the offence punishable under Sections 363/365/34/364/302/201/120(B) of the Indian Penal Code.

3. As per the prosecution case, the deceased was cut into pieces and during the scientific investigation, it has come that the petitioner has participated in the killing. One Sanjeet Kumar is said to have given the contract for the killing of the deceased.

4. Materials have come during investigation including scientific investigation to connect the petitioner with the crime.

5. Mr. Nachiketa Jha, learned counsel appearing for

Patna High Court CR. MISC. No.19902 of 2024(5) dt.06-09-2024 2/2 the petitioner has vehemently argued that nothing has been recovered from the petitioner and no part of the deadbody has been recovered. The petitioner is in jail since 30.10.2023.

It has also come during investigation that the petitioner along with other co-accused after killing the deceased have cut the deceased into multiple pieces and threw the same and also the murder weapon in the Kosi river. Therefore, the argument of Mr. Jha, that no part of the deceased has been recovered carries no weight.

7. Considering the facts and circumstances of the case and also the gravity of offence, I am not inclined to enlarge the petitioner on bail. It is accordingly dismissed.

8. The trial Court is directed to expedite the trial.

9. The Senior Superintendent of Police, Darbhanga is directed to see to it that the charges are framed at the earliest and the witnesses are produced on the next date fixed. (Sandeep Kumar, J) Saif/- U T
