2. This application is for grant of regular bail in connection with Bhagwanpur P.S. Case No.349 of 2024, registered for the offences under Sections 103, 3(5) of the Bhartiya Nyaya Sanhita.

3. As per the F.I.R., the petitioner and his grandson are said to have assaulted the victim on the pretext of land dispute. Petitioner and the deceased are brothers. It is alleged that the petitioner started throwing bricks on the deceased and subsequently the petitioner and his grandson assaulted the victim with hard and blunt substance.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 13.11.2024 and he claims clean

Patna High Court CR. MISC. No.13558 of 2025(4) dt.13-05-2025 2/2 antecedent. One injury has been found on the body of the deceased. He further submits that the petitioner is a teacher and was not present on the spot. He has been falsely implicated due to land dispute.

5. Considering that the petitioner and the deceased are brothers and only one injury was found on the deceased, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai/concerned Court below, in connection with Bhagwanpur P.S. Case No.349 of 2024.

7. The petitioner shall cooperate in the trial personally or through his counsel.
