JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 486 and 487/420 of the Indian Penal Code and Sections 6/13/17/29 of Pesticide Control Act.

Allegedly, the petitioner who runs a General Store Shop, indulged in manufacturing and selling duplicate goods in his said shop. Upon getting information to this effect, the Police conducted a raid and recovered certain items. Learned counsel appearing on behalf of the petitioner submits that even as per the First Information Report no offence is made out inasmuch as there is no basis to allege that any duplicate

In view of the submission as above, let the petitioner abovenamed, in the event of his arrest/surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 497 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
