The petitioner seeks regular bail in connection with Hilsa PS case no. 386 of 2017 registered for the offences punishable under Sections 341, 323, 307, 354(A), 380, 504, 506/34 of Indian Penal Code.

The allegation of the prosecution against the petitioner and other accused persons is assaulting the prosecution party with lathi, iron rod etc. resulting in injury to one Rahul Kumar.

The learned counsel for the petitioner submits that there is a bonafide land dispute prevailing between the parties and on the same day and for the same occurrence, case and counter case had been filed. It is further submitted that the father of the

Patna High Court Cr.Misc. No.45851 of 2017 (2) dt.21-09-2017 2/2 petitioner is said to have filed Hilsa PS case no. 388 of 2017 dated 17.06.2017. It is further submitted that the petitioner has no criminal antecedent and the injuries suffered by Rahul Kumar is said to be simple in nature. The petitioner is said to be languishing in custody since 15.07.2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Hilsa at Nalanda in connection with Hilsa PS case no. 386 of 2017.
