JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 216 of 2017, registered for offences punishable under Sections 399, 402/34 of the Indian Penal Code and Section 25(1-b), (a) and 26 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country made pistol.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from his possession. Moreover, he has sufficiently been punished for the said offence as he has been in judicial custody since 13.06.2017 and as regards criminal antecedent is concerned, he is accused in one more case on which he is on bail. Heard learned A.P.P. also.

No.42419 of 2017 (2) dt.14-09-2017 Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below that he shall release the petitioner on bail to his own satisfaction after submission of charge - sheet or if petitioner completes five months in judicial custody, whichever is earlier.
