JUSTICE BIRENDRA KUMAR ORAL ORDER 19-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in a case registered for the offences punishable under Sections 302,34 of the Indian Penal Code and 27 of Arms Act.

There is no eye-witness of the occurrence of murder, however, the informant claims to identify co-accused Shiv Shankar Sah on the spot. Petitioner is not named in the FIR and Shiv Shankar Sah has already been allowed bail by coordinate Bench of this Court in Cr. Misc. No. 20292 of 2017. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (Rs. Twenty Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.3975 of 2018 (2) dt.19-01-2018 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Charpokhari P.S. Case No. 83 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
