The petitioner seeks anticipatory bail in connection with Bhagalpur Industrial Area PS case no. 131 of 2017 registered for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act. The case of the prosecution is that the daughter of the informant was shot dead while traveling in a tempo and the FIR named accused persons are suspected to have killed her. The learned Senior counsel for the petitioner submits that the informant is not an eye witness to the alleged occurrence and the husband of the petitioner herein has already been granted regular bail by this Court by an order dated 9.2.2018 passed in Cr.
Patna High Court Cr.Misc. No.4282 of 2018 (3) dt.23-02-2018 2/2 Misc. No. 1540 of 2018.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, IX, Bhagalpur in connection with Bhagalpur Industrial Area PS case no. 131 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
