The petitioner is languishing in custody for the offence punishable under Sections 25(1-b)a, 25(1-AA), 25(1AAA), 26(ii), 35 of the Arms Act and Section 8/20(b)(ii) (B) of N.D.P.S. Act, 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner is in custody since 17.02.2018. Submission is that similarly situated co-accused has been granted bail by co-ordinate bench of this Court vide Annexure 2 and 3.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.13395 of 2019(3) dt.10-04-2019 2/2 amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ahiapur P.S. Case No. 727 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
