JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Banka (Barahat) P.S. Case No. 824 of 2019 for offences under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel further submits that the petitioner has been made accused in this case allegedly on the ground that he used suspicious certificate. The case was registered against the petitioner in view of the suspicion raised before Public Grievance Redressal Officer, Barahat in Complaint Case No. 523110111071903363 against which he filed appeal before the Additional Collector (P.G.R)

Patna High Court CR. MISC. No.12474 of 2020(2) dt.06-03-2020 2/2 and the appeal was allowed by order dated 01.02.2020 by the Appellate Authority holding that any action taken against the petitioner is not justified.

Considering the aforesaid, this Court is inclined to grant bail to the petitioner. Let petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 824 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
