====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Naya Gaun (Samho) P.S. Case No. 28 of 2003 lodged under Sections 414 of the Indian Penal Code and under Section 25(1b) a, 26, 27 of the Arms Act. As per the F.I.R. the informant got information that in the Jungle of Jamui some criminals gathered and planning for crime, the police party has attacked in the Jungle itself, in which 4 accused persons were arrested in which petitioner was not there.
Learned counsel for the petitioner submits that petitioner was neither arrested from the place of occurrence nor any arms recovered from him, therefore no offence under Arms
Patna High Court CR. MISC. No.14581 of 2022(2) dt.06-07-2022 2/2 Act made out against him. He further submits that petitioner is in custody since 22.01.2022 having clean antecedent. Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of this case that petitioner's name has come on the confessional statement of co-accused, he is in custody since 22.01.2022, charge sheet has already been filed and no criminal antecedent, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-XIV, Begusarai, in connection with Naya Gaon (Samho) P.S. Case No. 28 of 2003, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
