JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 31-03-2016 Heard the counsel for the petitioner and the State. The six petitioners herein are cited as accuseds of Chausa P.S. Case No. 105 of 2015, registered under sections 147,148,149,341,323,324,307,379,504 and 506 IPC and seek anticipatory bail. It is alleged that on the date of occurrence the petitioner no.1 spread stool, urine etc. at the gate of the informant which was protested whereafter petitioner nos. 1, 2 & 3 assaulted the injured with dangerous/lethal weapon(s) on the vital part. Insofar as petitioner nos. 4,5 & 6 are concerned, the allegation is of taking out money and assault with fists and slaps. It is stated that both parties are agnates. The injuries are
Patna High Court Cr.Misc. No.12630 of 2016 (2) dt.31-03-2016 2/2 not very serious in nature. There is a counter version also and the petitioners' side also received injury.
APP opposed the prayer and submitted that the injuries caused by petitioner nos. 1,2 & 3 are on vital part. Considering the facts and circumstances of the case, the prayer for anticipatory bail on behalf of petitioner nos. 1,2 and 3 is rejected.
Let petitioner nos. 4, 5 & 6, namely, Md. Jahrool, Md. Kokan and Md. Binha, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of CJM, Madhepura in Chausa P.S. Case No. 105 of 2015 on condition that one of the bailors of each of the petitioners shall be his own/close family member. In the event of framing of charge, the petitioners shall appear in person on each dates fixed at the trial. In case of default in appearance on two consecutive dates, their bail bonds shall stand cancelled. (Kishore Kumar Mandal, J) HR/- U T
