Petitioner apprehends his arrest in Sursand P.S. Case No. 23 of 2015 registered under sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
Allegation against the petitioner is that he abused and assaulted the informant by means of farsa as such he became injured and fell down.
Learned counsel for the petitioner submits that admittedly there was land dispute between the parties and for that a panchayat was arranged by the informant. There is case and counter case. The informant also got injury for which Sursand P.S. Case no. 24 of 2015is instituted on the basis of the fardbeyan
Patna High Court Cr.Misc. No.17220 of 2015 (2) dt.03-06-2015 2/2 of Nikhat Khatoon Moreover the injury as alleged to be caused on the head of the informant by the petitioner is simple in nature. Having considered the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M. Pupri, Sitamarhi in Sursand P.S. Case No. 23 of 2015, subject to the conditions as laid down under section 438(2) Cr.P.C.
