JUSTICE ARUN KUMAR ORAL ORDER 20-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 21.3.2018, seeks bail in Chautarwa PS Case No. 42 of 2018 registered under Sections 363 and 366 of the IPC.

The allegation in brief is that the informant's 18 years old daughter was found missing and it is alleged that this petitioner had taken away his daughter but after two days left her from his captivity.

Learned Counsel for the petitioner submits that statement of the girl who is major 19-20 years of age does not disclose it as a case of kidnapping rather she admits illicit affairs with the petitioner since one and half years, in fact this case was lodged after three days delay without any explanation and in order to put pressure upon the petitioner to marry with the informant's daughter present case has been lodged.

Having considered the said facts and circumstances, the petitioner, namely, Guddan Rocky @ Gudan Racky is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM I Bagha, West Champaran in connection with Chautarwa PS Case No. 42 of 2018.
