The petitioners apprehend their arrest in Kartahan P.S. Case No. 69 of 2015 registered for the offences punishable under Sections 341, 342, 323, 324, 454(B), 147, 148, 379, 504 and 506 of the Indian Penal Code.
The informant alleged that while his daughter was cutting grass, the petitioners along with his family members came and assaulted his daughter.
It is submitted that the occurrence took place on 28.09.2015, but the case was lodged on 01.10.2015 i.e. after three days of the occurrence. Father of the petitioners filed an informatory petition before the Sarpanch of the Gram Panchayat
Patna High Court Cr.Misc. No.12063 of 2016 (4) dt.24-06-2016 2/2 on 25.09.2015. The informant wanted to purchase a piece of land from the father of the petitioners and when the father of the petitioners did not agree the informant threatened to face consequences.
Considering the facts aforesaid and the fact that injuries are simple in nature, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vaishali at Hajipur in Kartahan P.S. Case No. 69 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
