JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 394, 411 of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.

It is alleged by the informant that three miscreants robbed his motorcycle and cash of Rs. 400/-. Subsequently, one person was apprehended who named the petitioner as one of the person who fled away from the place of seizure.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.16012 of 2023(2) dt.29-04-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not apprehended from the spot. Nothing was recovered from the conscious possession of the petitioner and only on the confessional statement of apprehended accused, he has been roped in the present case. The petitioner is languishing in custody since 24.09.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Bhawanipur P.S. Case No. 133 of 2022.
