2. The petitioner seeks bail in a case registered for the offence punishable under Sections-25(1-B)a, 26 & 35 of the Arms Act.
3. As per allegation, the police got information that some criminals were involved in dealing with the arms and ammunition in the house of the petitioner. The police raided the house of the petitioner. Three persons were arrested who disclosed their names as Nitish Kumar, Ashish Kumar and Abhijeet Kumar S/o Vinod Kumar. Some arms and ammunition were recovered from their possession. They disclosed that the
Patna High Court CR. MISC. No.24344 of 2024(3) dt.11-07-2024 2/3 petitioner was providing instruction to supply the arms and on his command, they used to send arms and ammunition.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He was not arrested at the spot and at the time of raid, he was in custody in another case.
5. On the otherhand, Sri J.N. Thakur, learned APP has opposed the prayer for bail and has submitted that the FIR itself shows that the petitioner was giving instruction from inside the prison to his associates in respect of supply of arms and ammunition.
6. A report regarding stage of the case was called for from the court below which has been received vide letter No. 10/24 dated 23-04-2024 and, is available on the record which shows that the trial could be concluded within 9-12 months.
7. Considering the above-mentioned facts and circumstances, prayer for bail of the petitioner in connection with Saharsa Sadar P.S. Case No. 277 of 2023 is rejected.
8. Learned trial court is directed to conclude the trial of the petitioner within a period of one year and if, the trial is not concluded within the stipulated period of one year, the petitioner may renew his prayer for bail.

8. With the aforesaid observation and direction, the present application is disposed of.
