The petitioners being the husband and father-inlaw of the complainant are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354, 379/34 of the Indian Penal Code. It is alleged that accused persons came in the house of the complainant and tried to consume liquor in her house which was protested by the complainant then she was assaulted and silver chain and box containing articles worth Rs. 3,000/- were taken away.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.14803 of 2015 (2) dt.13-04-2015 petitioners that petitioners have been made accused in the background of matrimonial dispute as the petitioner no. 2 has filed a Matrimonial Suit for restitution of conjugal life. Considering the accusation in the background of Matrimonial dispute and co-accused have been granted bail vide Cr. Misc. No. 10757 of 2015, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Complaint Case No. 207 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
