JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act. The prosecution case is that one Pick-up van was intercepted loaded with seventy bags of rice weighing 30 quintals. The driver of the vehicle namely Md. Rustam disclosed that he got the rice loaded from PDS shop of the petitioner. It is submitted by the learned counsel for the petitioner that admittedly the seizure has not been made from the petitioner and stock of the petitioner was verified but no irregularity was found. The petitioner is PDS dealer since 1993. Statement to the aforesaid effect has been made in paragraph 9 of the petition. Statement has also been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.12569 of 2016 (2) dt.17-03-2016 2/2 petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai in connection with Fulwaria P.S. Case No.181 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
