The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per the prosecution case, six accused persons variously armed are stated to have stopped the motorcycle of the informant and of having dispossessed him of his valuables including mobile phone etc..

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Rahul Kumar made before police which is inadmissible. Further material being relied on to falsely implicate the petitioner is the petitioner's confessional statement and his criminal antecedent.

Patna High Court CR. MISC. No.25118 of 2021(3) dt.20-12-2021 2/2 No incriminating article has been recovered from the petitioner's possession nor has he been put on T.I. parade. He is in custody since 23.5.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year 6 months, the Court directs the petitioner to be enlarged on bail in connection with Nagar P.S. Case no.12 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara or concerned court, Bhojpur at Ara.
