Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 96, 137(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his minor daughter aged about 13 years was kidnapped by Shankar and petitioner as disclosed by Sachin brother of Shankar.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant being friend of Shankar. It is also submitted that victim has come back and her statement was recorded under

No.15682 of 2026(3) dt.07-04-2026 2/3 Section 183 BNSS wherein she has supported the case of the prosecution and has stated that Shankar took her on a motorcycle and petitioner was also present, but then it is submitted that the said statement of the victim was recorded under parental pressure. It is next submitted that the victim and Shankar were in a relationship and had eloped and since petitioner is friend of Shankar as such he also came to be implicated. It is further submitted that petitioner is a student of Patliputra University, Patna, and had passed his Intermediate examination from Bihar School Examination Board, as would manifest from Annexure-P/2 series. It is also submitted that if privilege of anticipatory bail is granted to the petitioner, the petitioner will not abscond rather will co-operate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the fact that petitioner is a student, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties

Case No. 204 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS. 7.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner, despite giving assurance to this Court, is not cooperating in the investigation, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
