JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioner apprehends arrest in relation to Buxar (M) P.S. Case No.299 of 2014 instituted under Sections 363/366(A)/34 of the Indian Penal Code for allegedly having kidnapped the daughter of the informant.
Learned counsel for the petitioner states that earlier the daughter of the informant had eloped with one Amit Ram and went away to Punjab. Later on panchayati being held on 27.4.2014, the girl was returned to her parents upon bond being executed by said Amit Ram, in which the petitioner was a witness. After some time, the girl escaped and had gone to Punjan, who lives with said Amit Ram and this time the present F.I.R. has been lodged and the petitioner has been named merely because he was earlier a witness to the bond. Patna High Court Cr.Misc. No.17722 of 2015 (2) dt.08-06-2015 by the police and the same forms part of the case diary. Be that as it may, in the facts and circumstances of the case, in the event of his arrest or surrender in the court below within a period of four weeks from today, the petitioner above named shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar (M) P.S.
