This application is for grant of bail in connection with POCSO Case No.66 of 2016 arising out of Bakhri P.S.Case No.200 of 2016, for the offences under Sections 7/8 of POCSO Act.

Earlier the prayer for bail of the petitioner had been rejected by this Court, vide order dated 20.2.2017 passed in Cr. Misc. No.7180 of 2017.

Submission of the learned counsel for the petitioner is that the statement under Section 164 Cr.P.C. could not be considered in right prospect and further three witnesses have been examined and they have been declared hostile. The petitioner has remained in custody for about nine months.

Having heard both sides and from perusal of the order dated 20.2.2017, it appears that after consideration of her statement under Section 164 Cr.P.C., the prayer for bail of the petitioner was rejected.

Considering nature of allegation, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months. At the same time, the S.P.Begusarai is directed to ensure presence of remaining witnesses in the court concerned so that the trial may be conclude within the period as specified. With the aforesaid observation, this application is dismissed.
