The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366(A), 34 of the Indian Penal Code. It is alleged that minor daughter of the informant was kidnapped by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 05.11.2022, F.I.R was registered on 13.11.2022

Patna High Court CR. MISC. No.14384 of 2023(3) dt.20-06-2023 2/2 without explaining the delay. The victim in her 164 Cr.P.C statement has stated that she of her own lef with the petitioner. The petitioner is languishing in custody since 02.12.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil (Gaya) P.S. Case No. 914 of 2022.
