JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioners seek regular bail in connection with Ara Town P.S. Case No. 303 of 2017, registered for offences punishable under Sections 30(a) and 56 of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 131 litres of foreign liquor, from a safari vehicle and petitioners and two other accused persons were traveling in the said vehicle.
It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and have nothing to do with the alleged recovery. Further they have no criminal antecedent and have remained in judicial custody for two and half moths and other co-accused of this case has already been granted
Patna High Court Cr.Misc. No.38090 of 2017 (4) dt.24-08-2017 2/2 bail by a coordinate Bench of this Court vide order dated 18.08.2017 passed in Criminal Miscellaneous No. 39725 of 2017. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioners have no criminal antecedent and have remained in custody for two and half months, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. -IV, Bhojpur, in connection with Ara Town P.S. Case No. 303 of 2017. It is made clear that if the petitioners again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of their bail bonds.
