Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the I.P.C and Section 47(a) of the Excise Act. From the shop of the petitioner foreign liquor and country made liquor were recovered.
It is submitted by learned counsel for the petitioner that actual recovery was not made from the shop of the petitioner nor the petitioner was present in the shop. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within a period of six weeks and pray for regular bail in connection
Patna High Court Cr.Misc. No.14825 of 2015 (2) dt.13-04-2015 2/2 with Sakra P.S. Case No. 317 of 2014, pending in the Court of learned Chief Judicial Magistrate, Muzaffarpur. Accordingly the application is disposed off.
