JUSTICE JYOTI SARAN ORAL ORDER 01-04-2016 The petitioner disputes the reserved category population occurring in the population present at Annexure-3 and Annexure1. According to learned counsel this is not the correct figure. According to him the reserved category population is much low and in that view of the matter the constituency could not have been reserved. The publication under Rule 8(1) of the Bihar Panchayat Rules took place in April, 2015 and the petitioner has sat over the matter to raise objections at a time when the notification under Section 124 of the Bihar Panchayat Raj Act,

Patna High Court CWJC No.4991 of 2016 (2) dt.01-04-2016 2006 has already been issued. It is too late in the day to enter into such disputed issues of fact and even otherwise the issue raised by the petitioner cannot be deliberated upon in a writ jurisdiction. The forum is otherwise and the petitioner if so advised, can take recourse to such remedy.

The writ petition is disposed of.
