Petitioner seeks bail in Patahi P.S. Case No.81 of 2016 instituted for the offence under Section(s) 394 Indian Penal Code.

It is alleged that some unidentified person fired upon son of the informant causing injury to him and fled away with his motorcycle.

Case diary has been received.

Learned APP has submitted that the name of the petitioner has come in the confessional statement of co-accused, Mitthu @ Jangali Baitha, recorded in para 29 of the case diary. Thereafter, the police recorded the confessional statement of the petitioner in para 38 of the case diary.

Patna High Court Cr.Misc. No.31931 of 2017 (5) dt.29-08-2017 2/2 Petitioner is said to be in custody since 14.02.2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VIII, Motihari, in connection with Patahi P.S. Case No.81 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
