The appellant seeks pre arrest bail in connection with Gopalpur P.S.Case no.93 of 2017 registered for offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code and section 3(i)(x) of SC/ST (Prevention of Atrocities) Act. Allegation against the appellant and two accused persons named as Vikash, is that they kidnapped the victim and also assaulted her as well as tried to commit wrong with her. The victim has also supported the allegation in Annexure 2 and named this appellant.
Submission of the learned counsel for the appellant is that the FIR shows that in the present case no allegation has been alleged against him and he is in custody for about four months. Heard learned Special P.P. also, who has opposed the
Patna High Court CR. APP (SJ) No.2637 of 2017 (4) dt.18-10-2017 2/2 prayer for bail.
Having heard both sides at this stage, I am not inclined to grant bail to the appellant, however, the appellant may renew his prayer for bail after framing of charge in this case. (Vinod Kumar Sinha, J) chn/- U T
