JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-07-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Complaint Case No.267 of 2018 registered under Section 498(A) of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act.
The accusation is of torturing the complainant/ opposite party no.2 by her husband and other in-laws for nonfulfillment of the dowry demand of cash Rs.51000/- and removing her along with her minor children from the
Patna High Court CR. MISC. No.13094 of 2020(2) dt.24-07-2020 2/2 matrimonial house after snatching her personal belongings. Learned counsel for the petitioners submits that the petitioner no.1 is father-in-law, whereas the petitioner no.2 is mother-in-law of the complainant/opposite party no.2. In fact, due to some misunderstanding in between the complainant/ opposite party no.2 and her husband, the complainant/opposite party no.2 has lodged the present case with false allegation implicating the petitioners also.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, West, Muzaffarpur, in connection with Complaint Case No.267 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
