2. The petitioner is apprehending his arrest in connection with Khajekalan P.S. Case No. 558 of 2025 registered for the offence punishable under Sections 69, 316(2) and 318(4) of the Bharatiya Nyaya Sanhita, lodged on 26.12.2025 by the informant Pratima Kumari.

3. As per the prosecution story, the informant alleged that promising solemnization of marriage, the petitioner entered into physical relationship for last four years and later back tracked. In between, he also used her Google Pay to take money. This led to the FIR.

4. Learned counsel for the petitioner submits that the lady is major and whatever happened was consensual. She earlier made the same allegation with one Vikash Kumar vide Bypass P.S. Case No. 65 of 2021 in which she entered into comprise with Vikash Kumar and now the present case. Further, submission is that the petitioner has clean antecedent and only to put pressure on him to enter into marital relationship, the present case.

5. Learned APP opposes the prayer submitting that she has made allegation and has followed it up by supporting the said allegation under Section 183 of the B.N.S.S.

6. Taking into account the submission of the parties as also that the petitioner has no criminal antecedent, the lady is major, FIR is there, the petitioner will be facing the music, in that background, this Court is inclined to extend him the privilege of anticipatory bail.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Exclusive Special Judge (Rape & POCSO Act), Patna, in connection with Khajekalan P.S. Case

No.14740 of 2026(4) dt.01-07-2026 3/3 No. 558 of 2025 subject to the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhar Card/Voter Id/Driving License/Pan Card) to show his/her bona fide;

(ii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the investigation;

(iii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/Ankita U T
