The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147/148/149/504/506 of the Indian Penal Code and Section 27 of the Arms Act and 3 / 4 Explosive Substance Act.
As per allegation sixteen accused persons including the petitioner in the leadership of one Ashok Mishra made indiscriminate firing on persons belonging a particular community.
It is contended on behalf of petitioner that there is no injury on any one and some of the accused persons have already been granted anticipatory bail by different coordinate
Patna High Court Cr.Misc. No.11835 of 2016 (3) dt.08-04-2016 2/2 Benches of this Court, copies of such orders dated 6.8.2015, 29.9.2015, 9.11.2015 and 30.3.2016 passed in Cr. Misc. Nos . 30346/2015, 45057/2015, 52311/2015 and 12888/2016 respectively have been produced.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Muso Mahto be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Pakribarawan (Dhamaul) P.S. Case No. 126/2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawadah, subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
