By the impugned order the learned court below has allowed the prayer for substitution of the respondent no. 1 in place of the deceased appellant in the capacity of his legal representative on the basis of the will after setting aside the abatement as well. After considering the submissions and from the perusal of the impugned order, this Court does not find any error or illegality committed by the learned court below requiring interference under Article 227 of the Constitution of India.
The application is, accordingly, dismissed.
