The petitioner is languishing in jail since 02.03.2017 in a case registered for offences punishable under Section 30 of Bihar Excise Amendment Act.
The prosecution case as lodged by the Excise Sub Inspector, Sitamarhi is that the petitioner was caught hold by the S.S.B. with 30 bottles of Nepali saufi wine near Nepal border. It has been submitted by the learned counsel for the petitioner that he is innocent bears no criminal antecedent and nothing has been recovered from his conscious possession. However, learned A.P.P. for the State opposes the pryer for bail.

No.26022 of 2017 (2) dt.05-07-2017 2/2 Considering the facts and circumstance of the case and materials on record , let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Sitamarhi in connection with Complaint Case No. C 2/126/2017.
