The petitioners seek bail in a case initially registered for the offences under Sections-341, 342, 323, 326, 498(A)/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act and later on, Section-304(B) of the Indian Penal Code was also added. Allegation against the petitioners is that they along with other accused caused death of the deceased/victim due to nonfulfillment of demand of dowry. It has been submitted on behalf of the petitioners are in custody since 15-12-2017. The petitioner Nos. 1 & 2 are father-inlaw and mother-in-law of the victim respectively. The petitioners

Patna High Court Cr.Misc. No.14158 of 2018 (2) dt.22-03-2018 have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are separate from mess and property of husband of the victim. The charge sheet has already been submitted in this case. The petitioners have falsely been implicated in the present case due to petty family dispute.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 210 of 2016.
