JUSTICE BIRENDRA KUMAR ORAL ORDER 26-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code.

The FIR of the occurrence of robbery is against unknown. Petitioner is in custody since 09.12.2017. Submission is that nothing incriminating was recovered from possession of the petitioner nor the petitioner was ever put on T.I.Parade. Investigation is already complete. Only material is confessional statement of coaccused before the police. Petitioner has got no such criminal antecedent.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.16700 of 2018 (2) dt.26-03-2018 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Harnaut Police Station Case No.370 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
