The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 323, 341, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, It is stated that eight accused persons out of which six were named came at the place of occurrence and on the orders of the petitioner, Manish Patel and Pappu Singh fired on the informant injuring him grievously. It is submitted by learned counsel for the petitioner that on perusal of the FIR itself it would transpire that no overt act has been alleged against the petitioner who is at best said to

Having heard learned counsel for the parties and taking into consideration the contents of the FIR wherein the petitioner is described as order giver, the allegation of firing being specific on Manish Patel and Pappu Singh together with the petitioner having remained in custody for more than 1 year since 25.10.2021, the petitioner is directed to be enlarged on bail in connection with Harsidhi P.S. Case no. 281 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran.
