The petitioner seeks regular bail in Chandramandih P.S. Case No.119 of 2016 registered for the offences under Sections 304(B), 498(A) and 120/34 of the Indian Penal Code. Allegation as per the F.I.R. is that against the petitioner is that he caused death of his wife and the case is registered under Section 304(B) of the I.P.C. However, from impugned order it appears that statement of the victim has been recorded and as such charge sheet has been submitted under Section 498 (A) of the I.P.C.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and now he is custody for four months having no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,Jamui, in Chandramandih P.S. Case No.119 of 2016, subject to the conditions that (i) one of the bailers of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) The petitioner will not induce any witness or tamper with the evidence. (iii) The petitioner shall cooperate in the disposal of the trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled (Vinod Kumar Sinha, J) AnilKrSinha/- U T
