JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Motihari Town PS Case No. 843 of 2017 registered under Sections 379/34 and 411 of the IPC.
The allegation in brief is that one person was caught red handed while stealing motorcycle of the informant. Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, nothing has been recovered from his possession, except disclosure of his name by co-accused Ratnesh Kumar whom he had given three motorcycle but this petitioner has clean antecedent and is in custody since 27.11.2017. Having considered the said facts and circumstances, the petitioner, namely, Sunil Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Motihari Town PS Case No. 843 of 2017.
